Trademark Registration Online

The term “Trademark” refers to a mark that may be visually represented and may be used to distinguish one person’s goods and services from those of another; this can include the appearance of goods, packaging, color combinations, and other such details. Brand recognition and differentiation are made easier by trademarks, which are instantly recognisable by their distinctive logos. The registration of a trademark is permanent.

Registration of a Trademark

India’s Trademark Act governs the registration of trademarks as intellectual property. Intellectual property ownership, rights to exclusive use of the registered brand, and legal protection in the event of trademark infringement are guaranteed by Trademark Registration India. Anything that isn’t an actual product or service name or logo may be trademarked. The process of obtaining a trademark registration often takes more than a year. It is possible to display the TM sign once a trademark registration application has been submitted to notify the public that a trademark application has been filed.

How to Get Your Trademark Registered?

To register a trademark, an application needs to be filed with the trademark registrar. There are a few steps involved in registering a trademark.

Choosing a Brand Name:

Remember to choose a distinctive and memorable name/logo for your business. Recognizing your class is the second critical step in the process. Trademarks may now be registered in 45 different goods and service categories. Commodities are classified in classes 1 through 34, while services are classified in classes 35 through 45. You may see the class schedule online.

The first step in online trademark registration is to search to see if your selected mark is similar to one already registered by another party. On the other hand, you may do it yourself by going to the trademark registrar general’s online page. You may come across an option to do a public search on the website. Once you’ve selected this option, you’ll be prompted to choose a class and do an internet search.

Save the Search:

In the second place, you have the option of hiring an attorney, but this will be the most expensive alternative. Trademark opposition would lower the overall cost of a trademark’s legal services. In addition to searching, they will also assist in the whole process.

Applying for a Trademark:

There is no limit to the number of trademarks you may apply for in a single application. Form TM-A must be filled out to do this. The trademark may be registered in more than one class using this form. There are two distinct charge bands for this form’s submission:

Amounts in the range of 9,000 or 10,000 Rupees

This category applies to everyone who is not a start-up, small business, or individual. E-filing the form costs Rs. 9,000; submitting it in person at the Office of TradeMark Registrar costs Rs. 10,000.

Rupees 4,500 or Rupees 5,000 are Two Options.

This category includes individuals, small businesses, and start-ups. If you file electronically, the cost is Rs. 4,500; if you submit the paperwork physically, the cost is Rs. 5,050.

If you make a mistake when filling out the form, it might delay or possibly result in the rejection of your application. You must fill out all the information and provide a 9 by 5-centimeter picture of the trademark. Five copies of the same document may be required. When filing, be sure to include at least two extra copies of everything.

There are several ways to file, including by yourself, through an agent, or via an internet service. If you file electronically, you’ll get confirmation of receipt immediately; if you file manually, it might take anywhere from 15 to 20 days.
