Tatkal vs Regular FSSAI License 2026: Which to Choose?
Quick Overview

Tatkal (Instant) FSSAI License lets eligible low-risk food businesses, wholesalers, distributors, retailers, transporters, importers, and merchant-exporters get a digital license on the FoSCoS portal via self-declaration, with no pre-issuance inspection. It's valid for just 1 year, after which the business must transition to a Regular FSSAI license. Food manufacturers and processors are not eligible for Tatkal under any circumstance, regardless of scale. Regular licenses issued on or after April 1, 2026 carry perpetual validity with no renewal required, but come with standard document verification and, for State/Central categories, a physical inspection.

Tatkal is a self-declaration route, not an exemption from scrutiny; the absence of pre-issuance inspection is replaced by the risk of random post-issuance audits, and providing false information during the Tatkal declaration is a punishable offence under the FSS Act. Tatkal is also state-restricted: a few states and Union Territories do not currently support the scheme, so always confirm availability for your specific state on the FoSCoS portal before assuming Tatkal is an option.

Introduction

The Instant (Tatkal) FSSAI License/Registration scheme allows small vendors, small importers, merchant-exporters, wholesalers, distributors, retailers, and transporters to get the FSSAI license or registration spontaneously without waiting for strict inspection or pre-compliance formalities. The Tatkal license facility was made available worldwide on August 31, 2024.

However, this scheme cannot be availed by every food business, as only applicable to a few selected (usually small vendors or sellers). But how does the Tatkal FSSAI license/ registration is differs from regular FSSAI registration? Let's dive into this guide to know the difference between Tatkal vs Regular FSSAI license, process to apply for Tatkal registration, cost, timeline, pros & cons.

FSSAI Updates 2026

The FSSAI Amendment 2026 introduced major FSSAI updates that bring major changes and strict accountability for food business operators (FBOs). These are the core changes related to FSSAI updates 2026:

  • FSSAI License Validity: After the FSSAI's 2026 amendment,  food licenses issued on or after April 1, 2026 now carry lifetime/perpetual validity. However, this new validity rule does not apply to all existing licensed businesses. Those with licenses expiring after March 31, 2026 need to check whether they fall under the old or new framework.
  • FSSAI License/Registration  Threshold Limit: The small and medium food businesses enjoy relief from the FSSAI food license turnover threshold limit, as the old one has changed with new effective limits. The threshold limit is as follows: Basic registration (up to ₹1.5 crore), State license (₹1.5 crore to ₹50 crore), and central license (above ₹50 crore).
  • Deemed Registration for  Street Vendors: All street vendors, food trucks, hawkers, etc., are now treated as "deemed registered under FSSAI. They do not need to get an additional FSSAI license online if they are registered under the Street Vendors Act.
  • Petty Food Businesses: The definition of petty food business operators has been extended and includes a broad category of food businesses such as Street food vendors, hawkers, and itinerant vendors, Food truck and food cart operators, temporary stallholders (e.g., at fairs, melas, or markets), etc.

What Is a Tatkal(Instant) FSSAI License?

The FSSAI (Food Safety and Standards Authority of India) introduced the fast-track application process by means of the FoSCoS portal starting from July 1, 2024. The Tatkal FSSAI License/Registration Scheme was previously launched on April 28, 2024, only in a few of the states/UTs (Assam, Delhi, Gujarat, Jammu and Kashmir, and Kerala) on a pilot basis. After the successful run of the pilot phase, the order was passed to implement the Tatkal scheme across all states/UTs of India starting from August 31, 2024. However, in a few states like Chandigarh, Meghalaya, and West Bengal, the Instant FSSAI license scheme is prohibited due to regulatory requirements or food safety risk policies. But the Instant (Tatkal)  License and  Registration Scheme is partially enabled in Himachal  Pradesh.

Apart from these, states also have high-risk food category sectors like fresh meat, raw seafood, processing plants, and atmospheric cold storage that are barred from the FSSAI Tatkal license scheme. Under Section 61 of the FSS Act, 2006, the food businesses can face up to a ₹10 lakh monetary penalty for making a false declaration during the Tatkal license/registration process. The instant registration is issued digitally via FoSCoS without pre-approval inspection, usually eligible for low-risk food businesses.

What is a Regular FSSAI  License/Registration?

The regular FSSAI registration process is a standard route where all documents related to food premises and the owners are verified, and the operation place is inspected by the food inspector. Unlike an instant FSSAI license, the regular FSSAI food license online is stricter and multi-step. Furthermore, the FSSAI food license generally takes 7-60 days (depending on Basic/State/Central category and inspection load).

For example, if you apply for Basic FSSAI registration with proper documents and processes, it will take approximately 7-30 working days for processing. On the other hand, after implementing FSSAI Amendment Regulation 2026 (effective 1st April 2026), the regular license will be granted from 1st April 2026 and will be for a lifetime.

  • Foreign Trade Direct Operation: The merchant exporters are eligible for the Tatkal FSSAI  license, but the direct importers who operate high-risk food items and require customs safety tests must go through the standard  FSSAI license registration.
  • Businesses Operating in Non-Enabled States/UTs: On 31 August, 2024, the  Food Safety and Standards Authority applied the instant registration scheme PAN-India, but a few states are still excluded from this scheme. These states are Chandigarh, West Bengal, and Meghalaya.
